My friends and I want to go to Cedar Point this summer, but one friend is not allowed to go to the States because he has a record. Long story short, it was a long time ago, it involved marijuana, and it wasnt his fault. How can he go about patching the incident up so that he can travel to the States? Edit: Just to clear things up, we live in Canada. For as long as Ive been alive and traveling back and forth across the border, all you needed was a birth certificate and a piece of picture ID, tops. Starting this June we will need a passport to cross the border, but a VISA is not yet necessary. ~~~ Alexxx ~~~

You would need a pardon from the President. As far as I know he is the sole person who can grant a pardon. Over here it is either the President or a Governor of the state you live in. You can go to court and get an expungement of the record if it has been a long time and it was not a serious offense. Or he can apply for a waiver after 5 yrs.

Wait until the country he lives in has no VISA requirement. My uncle has a criminal record in Korea, but was finally able to visit America after they lifted the requirements.

Your friend is inadmissible to the United States for life (without a waiver) under Section 212 2A1 amp; 2A2 of the INA. The US Government does NOT honor foreign pardons, so even if your friend gets a pardon, the friend will still be inadmissible under the INA. Your friend will need to apply for a waiver of inadmissibility, which will take 6 - 9 months to apply for and be approved (approval is not guaranteed). The last criminal activity must have been at least 5 years prior to the application for the waiver. The cost is approx $545, and involves getting fingerprinted. Failure to have a waiver will result in your friend being refused again, and possible criminal charges.
