I am having a 2 story extension built, but my neighbour wont let me put some scoffolding up on their there any law that states that they have to allow us access . ~~~ Nikki Y ~~~

Without knowing the exact legalities i would have thought that you would need their express permission to erect anything that encrouches on their land. So in a nutshell i think, yes, they can!

If there is an easement you can use that land but not the neighbors property. They may not want to be liable if there is an accident. When you got permits you should have looked into this.

Its their property. Unfortunately, they dont have to grant you any permission or an easement if they dont want to. You can check with your local building department (town hall, etc.) to see if there is any way around it.

Why would you imagine you have any rights whatsoever to their property? Its a bit mean of them, but theres really nothing you can do.

in UK law the only time they have to allow access is if it is wrote into the deeds of the house, but this is usually only access it would be very doubtfull if it allowed you to erect scaffolding on their land as erecting scaffolding is not access. i am surprised you are building an extension which requires the scaffolding to be erected on their property as usually planning permission would not be granted for a structure which stands on or so close to a land boundary.

Sounds like your neighbour is an asshole. Unfortunately I think that because its their land you have to get their permission to put anything on it, may it be scaffolding or anything else.

If it is private property then yes, they can stop you. It is trespass if you or anyone else enters private property without permission.

Of course they can. If you are building so close to the property line that you cannot fit scaffolding in, you are more than likely in code violation on Setbacks.

Most places, they do not have to allow you to use their property. Most places an extension close enough to the property line that the scafolding would tresspass on a neighbor requires a varience which the neighbor must approve. Be very nice to that neighbor.

Yes they can. You are entitled to reasonable access for maintenance but not for new construction. (UK) Youll have to bribe your way out of this.

Generally, you have no right of access through a neighbors property. Maybe you could offer to pay them rent to set up the scaffold. If that does not work then your builder will have to use a different system, ie. erecting completed walls from inside. That is how we build homes in San Francisco.

You need a Party Wall Agreement. This covers works which take place on or near the boundary of your neighbours property. Normally this is negotiated prior to works commencing, so you may have burnt your bridges on that one. Id say your best bet would be to grovel, then put a Party Wall agreement into place. The Party Wall Act of 1996, sets out exactly what rights you have to access your neighbours property for repairs or construction purposes.
